Foreclosure Defense & Loss Mitigation
Foreclosure Defense & Loss Mitigation
The Legal Defense of Judicial Foreclosure, Loan Modification, Short Sale, Deed in Lieu of Foreclosure.
The threat of losing your home can be overwhelming. By hiring an attorney to fight the foreclosure and negotiate with your lender, it is very possible to save your home or in the alternative, to design a proper exit strategy to mimimize your liability in the event that you cannot keep your home or an investment property.
The Defense of Foreclosure may allow you to:
Postpone the Foreclosure of your home.
Allow time to sell your home in either a traditional sale or short sale.
Negotiate a loan modification or a payment workout to reinstate your loan.
What are your rights? Banks must follow the law when initiating a foreclosure. Therefore it is very important to hire a knowledgeable attorney. Failing to do so may allow a bank to take advantage of you and improperly or quickly foreclose on your property. Anthony Rumore, P.A., has many years of legal experience in defending foreclosure actions and negotiating with mortgage lenders. We take pride in helping people get back on their feet. WHAT IS A SHORT SALE?
A short sale, also known as a “negotiated settlement” or “short pay”, occurs when the lender agrees to accept less than the amount owed to satisfy a loan as an alternative to foreclosure. All mortgage lenders have several layers of bureaucracy, insurers and investors that will have to be negotiated with in order to get a short sale approved. We are extremely experienced at negotiating with mortgage lenders. We can assist you in the short sale process by:
Helping you to identify an experienced listing real estate broker and directing the activities of that broker. Our office will negotiate with potential buyers on your behalf, prepare all agreements, contracts and addendums and submit requisite preliminary settlement closing statements to the lender.
We will also issue title insurance for the purchase and close the transaction, if agreeable to the parties.
Our staff will communicate with all the parties each step of the way to make sure that the closing occurs smoothly and within both the buyer's and seller's timelines.
We work with lenders around the world on a daily basis and know the best strategies to help prevent foreclosure. We can help you stop foreclosure no matter how dire your situation is, but the sooner you act, the better. The longer you put off getting help, the harder it will be for us to help you.
